Our Terms and Conditions for Photobooth Hire

Introduction and Agreement

These Terms and Conditions outline the agreement between The Luxe 360 Booth (referred to as "Supplier") and the person booking The Luxe 360 Booth for their event (referred to as "Customer").

Definitions

- Supplier: The Luxe 360 Booth, trading as The Luxe 360 and The Luxe 360 Photo & Video Booth.

- Customer: The person booking The Luxe 360 Booth for their event.

Service Period and Payments

The Supplier agrees to provide a Photo Booth that is operational and available for use for the agreed service period. A partial, non-refundable deposit is required to secure the reservation. The remaining balance is due 28 days before the event, unless otherwise agreed.

Design Work and Response Timeframes

Design work will commence upon receipt of the deposit unless otherwise agreed. It is the Customer's responsibility to respond promptly to form requests. Failure to respond within 7 working days may result in design decisions made by the Supplier.

Access, Space, and Power Requirements

The Customer must ensure an appropriate space is provided for the Photo Booth at the venue, along with a mains electricity supply comprising a single 13amp socket located within the designated area. The space must be straight, dirt-free, level, and suitable for operation. Failure to comply may result in additional charges or refusal of service. Photo booths cannot get wet and must be on level ground.

Set-up and Take-down

The Supplier requires access to the venue 90 minutes before and after the hire time for set-up and take-down for most photo booths. If additional time is required for certain photo booths, the Supplier will inform the Customer. It is the Customer's responsibility to ensure timely access is granted as per the Supplier's request.

Parking and Unloading

The Customer must provide sufficient unloading space and free parking close to the venue to facilitate the safe unloading of heavy equipment. Failure to provide suitable arrangements may result in delays, which will be deducted from the hire time.

Alcohol and Drugs

The Supplier reserves the right to refuse service to intoxicated guests or anyone who is abusive towards staff or fails to follow safety instructions. Breathalyser tests may be conducted if necessary. Aggression or refusal to comply will result in the guest being asked to leave and banned from using the machines for that specific night, with no refunds given. The staff on site's decision is final.

Insurance and Liability

The Supplier is fully insured but not liable for any illness, loss, damages, or injuries resulting from negligence or malicious damage. The Customer assumes responsibility for any loss or damage caused during the event. This includes damages caused by guests not following instructions and hitting the photo booth arms, unit, props, lighting, or any other of the Supplier's property/equipment. The Customer is responsible for all damages caused by their guests.

Indemnification and Miscellaneous Terms

The Customer agrees to indemnify the Supplier against any liability related to the event and the use of equipment. Any provision deemed unlawful will not affect the validity of the remaining terms.

Digital Copies and Data Storage

Digital copies of event images/videos will be stored for a maximum of 4 weeks after the event. Retrieval within this timeframe is subject to an additional charge.

Behind-the-Scenes Photos/Videos and Additional Equipment

Photographs and videos taken during the event may be used for promotional and marketing purposes by The Luxe 360 Booth. Additional disclosure out of this must be agreed upon in advance.

Corporate Events and Limitations

Corporate logos may be used for promotional purposes and marketing on our website/social media. The Supplier is not liable for any damages arising from the use of materials on the company website.

Legal Application

These Terms and Conditions will apply to the purchase of the services and goods by you (The Customer).

We are The Luxe 360 Booth, a sole trader business registered in England and Wales. Our registered head office is at Sherwood Parade Business Offices, NG21 0JP. You can contact us via email at cs@theluxe360.co.uk or telephone at 07377389937.

Interpretation

- Supplier: The Luxe 360 Booth, trading as The Luxe 360 and The Luxe 360 Photo & Video Booth.

- Customer: The person booking The Luxe 360 Booth for their event.

Service Period

The Supplier agrees to provide a Photo Booth that is operational and available for use for the agreed service period. The Supplier will arrive 1 to 3 hours before the hire time for setup, depending on the package and photo booth purchased.

Payment and Deposits

A partial, non-refundable deposit is always required to secure the reservation. The remaining balance is due 14-28 days before the event, depending on the photo booth and package booked, unless otherwise agreed. Additional rental charges will apply for use beyond the agreed service period.

Payments on Event Date

If you choose to pay a deposit and the balance on the event date, full payment is required after setup and a test spin. Any delay in payment will reduce your hire time.

Agreed Arrangements for Hire

The Customer must ensure adequate space, electrical supply, and safety measures are in place. The Supplier reserves the right to refuse service if these conditions are not met. Any damages to equipment, props, or accessories caused by the Customer or their guests will be charged to the Customer.

Contacting the Venue/Event Planner

We will try to work with your event planner/venue as much as we can; however, if they fail to respond to us, we will have to contact and deal with the hirer/customer. In instances such as this, spaces must be made available on arrival, and we are not liable for any lost hire time/issues.

ULEZ, Clean Air Zone Fees, Taxes, and Parking

Any ULEZ fees, clean air zone fees, taxes, and parking charges are the Customer's responsibility in addition to the package prices. If parking is not free at the venue, reimbursement needs to be made. All parking should be suitable for a van or reimbursed, including parking for staff vehicles who attend your photo booth hire. Depending on the package, this can involve multiple vehicles' parking being paid for. All parking costs for staff must be reimbursed. ULEZ is a government tax over which we have no control.

Insurance Documentation

Proof of insurance coverage will be provided directly to the venue in line with GDPR regulations and not to the customer.

Limitations

In no event shall the Supplier be liable for any damages arising from the use or inability to use materials on the company website. The Customer is liable for any damage to equipment, props, or accessories, including scratches and marks.

Deposits and Cancellations

Deposits are non-refundable as they secure the date and prevent other bookings. If the event is cancelled, the deposit can be held as credit or used for another date but will not be refunded.

Originality and Trademark Protection

We are proud to have been the first to offer 360 video booths in Nottingham, a concept that has since been widely replicated across the UK. Additionally, we pioneered the Drone 360 experience. To safeguard the unique build of our machines and protect our registered trademark, we reserve the right to request that photographers, videographers, and members of the public refrain from recording or videoing the exterior of our machines. Furthermore, we reserve the right to place our logo at the end of your videos as a measure to protect our trademark. Should you prefer the logo to be removed from your videos, please notify us when we send you the mock-up for approval.

All videos/photos and behind-the-scenes footage

If included in your package we will send you photos and videos of the behind the scenes footage on a dropbox link.

Outside Events

Our photo booth machines, accessories, plugs or lights cannot get wet and we reserve the right to refuse to put our machines outside if it will be putting them at danger of damage and our say is final. No refund will be given if there is not an alternative place to put the photo booth.

We will always try and work with your venue to find an alternative and are happy to have the machine in a sheltered area like a gazebo etc.

Attendance on the Machine

We cannot be held liable if there is low usage on your photo booth machine as we are simply the hire company. We will always try and encourage people to use the machine with our friendly staff and team without being overzealous at events.

Shake/Bounce on Videos

We use a trademarked arm which provides 80% less bounce/shake than competitors with our 360 Video Booths. However that does not mean it guarantees 100% no shake or bounce- we put up signs and do pre-warn at the event when running through safety instructions to not jump/shake the machine as this will lead to shakey footage and footage bounces.

If in any instance anyone does not listen to this instruction we are not liable for shakey/poor footage.

Conduct while on the Photo Booths

We expect all guests to act appropriately on the photo booth this means no nudity, no attempts to grab the camera or arm or hit it and no stunts whilst using any of the photo booths.

The hirer will be responsible for any damage caused.

Our Terms and Conditions for Photobooth Purchases

Luxe 360 Photo booths Warranty Terms and Conditions

Thank you for choosing Luxe360 Photo booths. Please carefully read and review the following terms and conditions which are our full terms and conditions, which govern the warranty coverage for our photo booths:

1. Warranty Coverage:

Luxe 360 warrants that our photo booths are free from manufacturer defects, ensuring they meet our high-quality standards. This warranty extends for a period of five (5) years from the date of purchase and 2 years on certain other photo booths.

2. Warranty Exclusions:

This warranty does not cover malicious damage, loss or theft, accidental damage, neglect, improper servicing, use of non-authorised parts, or incorrect assembly of the photobooth.

The warranty does not cover if the machine is not assembled correctly and as per our instruction videos/guides/advise.

If you ask us for custom specific set up videos - there maybe a wait for these and you must wait before setting up the item- any damage from attempting to set up the item without following our tutorial videos will not be covered by the warranty and you will be liable to pay for replacement parts.

If you lose any screws/components/parts this is not covered under the warranty as this is loss. A surcharge for replacement parts will occur.

All orders are custom made so may have slight black weld/oil residue on occasion which strengthen the metal/components and in most instances are covered by cloth over the bars dependent on the photo booth- this is purely cosmetic and not a defect and not covered under warranty.

Scratches/cracks/dints made by pushing/forcing units excessively causing dint/fracture to components or using drills/screwdrivers not advised in our instructions is not covered.

Wear and tear of the photo booth, flight case and any components is not covered.

3. Warranty Conditions:

All warranty claims must be submitted in writing to Luxe 360 and are subject to review and approval by our team and external underwriters, the underwriters decision and our decision is final. To maintain warranty coverage, it is imperative to adhere to the provided guidelines and instructions for setup, maintenance, and servicing of the photo booth. Any alterations or modifications to the photo booth must be pre-approved by Luxe 360. Return postage for Warranty Claims is the responsibility of the purchaser.

All machines are photographed, tested and have videos recorded of them packed and tested before dispatch to prevent fraud and ensure quality checks have been done.

During the sales process- we will contact you to check any logos are right and correct, if any revisions are needed you can let us know.

If you fail to properly check the logo and only notify us after receipt of the goods that the logos are wrong, this falls as an error on your part and we hold no liability.

During the warranty investigation process or for damage investigations- we may require detailed videos and photos - if you fail to provide these your warranty will be voided and we will not be liable to replace any units if you fail to comply.

4. Manufacturer Information:

Luxe360 is a small family-owned business based in the UK. We take pride in manufacturing and assembling our photo booths in the UK but are 100%. transparent even on our advert page that all components are not 100% from the UK as this is logistically impossible, however all components are tested ensuring high-quality craftsmanship. Please note that due to storage limitations, we may ship our products to fulfilment centres globally, including eBay and Amazon. While your item may come from one of our fulfilment centres globally, rest assured it is clearly marked to customs and the UK authorities as UK manufactured because it is and contains Luxe 360 Booth paperwork inside along with a declaration. Some components or parts may be sourced from abroad to maintain the best quality and functionality of our photo booths.

Batteries are a prohibited item to be shipped and not included in the purchase neither are powerbanks.

5. Shipping Information:

We strive to produce each Photo booth within 72 hours and aim to have it shipped to you within a further 72 hours. However, during busy periods and bank holidays, there may be delays which we will communicate to you promptly.

6. Returns and Refunds:

We do not accept returns once a photo booth is manufactured as all orders are custom made with a custom logo making it a custom product. Any returns or warranty claim postage is at the buyer's cost. Refunds will only be issued in the instance of a technical manufacturer defect issue with the photo booth preventing it from functioning correctly. Any other refund requests will be considered individually at our discretion.

7. iPads and Computers:

Unless specified otherwise, iPads or computers are not included with the photo booths purchases and are the responsibility of the purchaser.

  1. Delivery Damages- any damages to products, components or accessories must be reported in 48 hour to the business or will not be accepted and we will not be liable.

    9- Proof of Trademark on Photo Booths and CE Certification.

    In accordance with our commitment to ensuring the accuracy and authenticity of our brand representation, we reserve the right to prominently display our CE certificate and trademark on our website. This measure is essential to distinguish our products and services from those of similarly named companies and to safeguard against potential instances of fraud or unauthorised alteration of our documents. We appreciate your understanding in this matter as we prioritise the integrity and credibility of our brand and are happy to provide these on request after purchase.

General Provisions:

By purchasing a photo booth from Luxe360, you acknowledge and agree to abide by these terms and conditions. This document constitutes the entire agreement between Luxe360 and the purchaser regarding the warranty coverage for our photobooths.

Governing Law:

These terms and conditions shall be governed by and construed in accordance with the laws of England and Wales. Any dispute arising out of or in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales.
